Theft occurs when someone physically takes property that is of value to another person with the intent of permanently depriving that person of the property in question. Armed Robbery
Armed robbery is the commission of theft with the use of a weapon. There are typically three types of armed robbery cases. Cases where a stranger holds up another person and displays or mentions a gun or knife in their possession, is a case of armed robbery.
Bank or store robberies, where the display or mention of a weapon takes place is another form of armed robbery. In some states, the offender does not have to be physically carrying a weapon at the time to be charged with armed robbery. The offender only has to mention that they have one.
Robbery that takes place in a home with the display or mention of a weapon is also armed robbery. This type of crime can also be charged as armed home invasion or armed burglary, depending on the state in which the crime occurred.
Home Invasion
A home invasion takes place when an offender or offenders force their way into an occupied residence in order to commit a robbery or other crime. An occupied residence may include a home, an apartment or a hotel room.
Burglary
Burglary by definition is the trespassing, breaking and entering of another person's dwelling with the intent to commit a felony. In some jurisdictions, there are varying degrees of burglary and the severity of the sentence is determined by the degree of the crime that has been committed.
Carjacking
Carjacking is the crime of stealing an occupied motor vehicle. In most cases the offender is armed and the driver is forced out of the vehicle under threat of physical injury. In cases where there are other occupants in the vehicle, they may be forced out of the car as well, or they may be taken hostage. In the case of taking hostages, other criminal charges will be filed against the offender, such as kidnapping.
