A home invasion takes place when an offender or offenders force their way into an occupied residence in order to commit a robbery or other crime. An occupied residence may include a home, an apartment or a hotel room.
Burglary by definition is the trespassing, breaking and entering of another person’s dwelling with the intent to commit a felony. In some jurisdictions, there are varying degrees of burglary and the severity of the sentence is determined by the degree of the crime that has been committed.
Carjacking is the crime of stealing an occupied motor vehicle. In most cases the offender is armed and the driver is forced out of the vehicle under threat of physical injury. In cases where there are other occupants in the vehicle, they may be forced out of the car as well, or they may be taken hostage. In the case of taking hostages, other criminal charges will be filed against the offender, such as kidnapping.
