Elements of a Kidnapping Case

Often, in the United States, kidnapping involves a parent taking illegal custody of a child in violation of a court order. If a parent has been denied legal custody and transports the child anyway, that parent can be charged with kidnapping.

Kidnapping Versus Abduction

At first, abduction only referred to the taking of women and children against their will. Now, abduction can apply to the taking of adult male victims as well. The offender may use different methods of violence, fraud, or persuasion in order to abduct their victim. This also includes convincing the victim that it is in their best interests, or the best interests of someone close to them, that they comply with the offender's wishes. In many cases, abduction and kidnapping are interchangeable in terms of legal matters.

Kidnapping Conviction

If the offender is successfully convicted of kidnapping, there will be a lengthy prison term sentenced. Also, if the offender has transported the kidnapping victim across state lines, this may result in additional federal charges being brought against the offender.
